MARGAO: The State Election Commissioner has passed an Order disqualifying Loutolim Sarpanch Inacio Fernandes under Section 10(d) of the Goa Panchayat Raj Act, 1994. The petition was filed by Franky Monteiro, a resident of Loutolim.
According to the petitioner, two shops were leased out to Fernandes. One shop in the old market was taken on lease by Fernandes in 1993 and another shop in the new market was taken on lease by him in 2009. According to Monteiro, Fernandes was bound by contract with the Panchayat and therefore liable to be disqualified as panch member of Loutolim Panchayat under Section 10(f) of the GPR Act 1994.
Monteiro further stated that the respondent had not paid rent for one shop from April 2009 onwards and the other shop from 2012 onwards, hence, he is in arrears payable to the Panchayat and is liable for disqualification in terms of Section 10(d) of the GPR Act.
