The High Court came down heavily on one of the petitioners, Kashinath Shetye, stating that if the petition had been filed by Shetye alone, it would have been rejected.
This observation was made by the High Court after records were placed before court, which clearly indicated that Kashinath Shetye had an axe to grind against the State Government because of his transfer orders.
The High Court noted that the writ petition filed by Kashinath Shetye challenging his transfer order was dismissed on November 30, 2009 and on December 1, 2009, Kashinath Shetye applied for intervention in PIL Sou Moto Writ Petition No. 1/2009 regarding procurement of CFL Bulbs by the State Government, which application was dismissed on February 16.
The High Court also held that the writ petition was filed by Kashinath Shetye after his transfer and his representation against the transfer was rejected.
