The Bombay High Court at Goa on Wednesday directed the Village Panchayat to act in accordance with law against illegal structures by Fomento Resorts & Hotels Pvt Ltd, in survey no 246/2 at Baiguinim beach.
The Village Panchayat had ordered to demolish the structure within seven days time if relevant documents were not produced. The order was then challenged before additional director of panchayat, and respondent hotel was granted six months to obtain relevant permissions from authorities against illegal construction in question.
When the matter came up for hearing last week, the Court took exception to this attempt of quasi-judicial to overreaching its jurisdiction.
Granting stay on the order, the High Court ordered additional director of panchayat to remain present in the Court today.
Through Advocate General Subodh Kantak, he however submitted that he was not aware of the pendency of the petition before High Court.
He was also pointed out this fact was not brought to his notice during conduct of the hearing.
The High Court accepted his explanation with a warning that he should be cautious in future while hearing such matters.
