Man acquitted of murder bid

MARGAO: Additional Sessions Judge I Edgar Fernandes on Tuesday held Francisco Costa from Quepem guilty of causing grievous hurt and sentenced him to one year simple imprisonment but acquitted him of attempt to murder.
Public Prosecutor Subhash Dessai argued that the accused used to habitually ill treat his wife and that on August 14, 2017 he hit her with a dhanda causing grievous injuries and said in fact it was an attempt to murder.
However Adv Julius Gomes arguing on behalf of the accused pointed out that he had no history of any criminal act earlier and further argued that there was no evidence except for the wife’s statement that he used to ill treat her.
The Judge holding that he could not go with the statement of the wife alone as there was no other evidence proving that she used to be harassed by him sentenced Francisco to undergo one year’s imprisonment for causing grievous hurt and also pay a fine of Rs 10,000.
 failing which to undergo two months simple imprisonment.
The time spent in jail by the accused will be set off from the sentence period and given the fact that he has been in custody since the time of the incident, he is likely to be set free as soon as he pays the fine of Rs 10,000.
