MARGAO: Principal Sessions Judge B P Deshpande on Friday heard arguments on the anticipatory bail application of Leader of Opposition Chandrakant alias Babu Kavlekar and posted the matter for order on March 1.
Adv G D Kirtani appearing for the State argued that the case was filed under the Prevention of Corruption Act against Babu Kavlekar when he was the chairman of the Industrial Development Corporation which is housed in Panjim and hence the crime was committed in Panjim.
He argued that since the office of public service was in Panjim the crime committed under the office is also deemed to be committed in Panjim and hence the case was registered in Panjim and therefore argued that the bail application ought to be decided by the North Goa Sessions Court.
However, appearing for Babu Kavlekar Adv Surendra Desai argued that he feared arrest would take place in South Goa and the properties claimed to be purchased by way of corrupt practices were all in South Goa and therefore, the bail application was moved before the South Goa District Court.
Besides, he argued that Savitri Kavlekar who is also accused in the case, is based in South Goa and the properties are in her name are located in South Goa and hence the application had to be moved before the South Goa District Court.
He also pointed out that in the era of transit bail it was acceptable to move the bail application in one court and once bail is secured move to the relevant court.
Judge Deshpande fixed the matter for March 1.
