MARGAO: The high court has quashed the FIR dated July 27, 2013 registered against the Headmistress and the Chairperson of Kamlabai Hede High School.
While allowing the writ petition filed by Sushma C Hede, headmistress and chairperson of Kamlabai Hede High School, Dr Ramkrishna Tukaram Parkar, Justice F M Reis and Justice Z A Haq has directed the Magistrate which had ordered the registration of the FIR to consider the matter afresh and take a decision after hearing the state according to law.
“We are of the view that as the learned Magistrate has not applied his mind to the subject matter and has not dealt with the controversy on the basis of the material on the record, the submission as made on behalf of the petitioners, cannot be considered at this stage,” the High Court observed.
President of Bailancho Ekvott Auda Viegas, against whom the police had also registered the FIR said it is sad that the order of the JMFC, Ponda and the subsequent FIR registered by the Ponda police was misused by persons with vested interest to mindlessly demand her arrest and the arrest of the headmistress, the Chairperson of the High school.
