S Collector told to file affidavit

The Bombay High Court at Goa Wednesday directed the Collector, South Goa, to file an affidavit about missing inward and outward register from his office for a period between February 07 to March 07.
He has also been asked to report on the outcome of the inquiry initiated by the deputy collector and what action has been taken so far in the matter. The matter came to light in the petition filed by Colva Civic and Consumer Forum that objected a residential project coming up in the area on the grounds that licences obtained for the project was bad in law.
The petitioner brought out that the respondent Akar Creations could not have obtained exemption certificate as it was not eligible for exemption.
The government advocate S R Rivonkar told the court that deputy collector has filed an affidavit wherein he has stated that inward and outward register for the subject period of two months is missing from the office of the collector and in-charge clerk was on leave during that period. However, an inquiry has been initiated, he said.
Taking serious cognizance of the matter the Division Bench of Justices S B Deshmukh and U D Salvi ordered the Collector to file fresh affidavit.
Meanwhile, one of the purchasers of the property today filed an intervention application opposing the petition.
The petitioner was represented by Adv Nigel Da Costa whereas senior counsel Atmaram Nadkarni appeared on behalf of Akar Creations.
The next hearing in the matter is fixed for September 24.
