Mickky, Diniz to appeal dismissal of revision plea

MARGAO: The case against Mickky Pacheco and his friend Mathew Diniz was adjourned to January 17 for framing of charge as both the accused were not present in court and their advocate submitted that the order of the Sessions Court would be challenged in the High Court.
It may be recalled that Mathew Diniz had filed a revision application before the Sessions Court against the order of the trial court to frame charges against him and Mickky in the infamous casino case that happened in May 2009.
However, the Additional Sessions Judge I Edgar Fernandes on October 23 dismissed the revision application and reverted the case to the trial court for framing charges. When the matter was called out on Tuesday Adv Vivek Naik representing Mathew Diniz said his client would prefer to appeal the Sessions Court’s order before the High Court.
Assistant Public Prosecutor Coleman Rodrigues demanded that the court should be informed in writing about the plans to appeal before the High Court and also demanded an exemption application for the absence of the accused.
As Adv Vivek gave both the applications, the matter was adjourned to January 17 to give time to Mathew Diniz to file his appeal before the High Court.
