PANJIM: The Transport Department has told the High Court of Bombay at Goa that they will issue challans to all private buses that ferried delegates to participate in the January 2014 election campaign rally addressed by BJP’s then PM candidate Narendra Modi at Merces grounds.
The department in its affidavit before the bench agreed to fine all private buses identified by petitioner Sudip Tamankar that violated Section 192-A of the Motor Vehicle Act.
Under the section, the buses will have to pay a fine of Rs 2000 or their licences to operate on the routes will be suspended. The High Court bench comprising Justice F M Reis and Justice Nutan Sardesai ordered Transport Department to furnish the compliance report within six months.
The order also states that the authorities shall ensure that in future whenever buses are used for such occasion the provisions of Section 87 of the Motor Vehicles Act, wherever applicable, are complied with.
While filing the petition, Tamankar had attached pictures of the private KTC buses which were used to ferry the BJP workers.
During the hearing of the case, KTC had given an undertaking that in future necessary intimation in terms of Section 101 of the Motor Vehicles Act would be made to the authorities concerned.
The lawyer representing KTC stated that though there was a lapse in not intimating the authorities concerned, in future such intimation shall be duly complied with.
