PANJIM: The High Court Monday dismissed both petitions that were filed challenging the government decision to cancel appointments of 45 commercial tax officers. The court held that while making these appointments the entire selection process and appointments were contrary to the selection rules and dismissed the petitions.
The Commissioner of Commercial Taxes, Panjim had issued an advertisement on January 12, 2011 inviting applications from eligible candidates to fill up posts of commercial tax inspectors. In response, 1710 candidates had applied, that included the petitioners.
After the written test, 250 candidate were shortlisted and after this oral interviews were held and results were declared on 23 December 2011. On the very same day commissioner of commercial taxes issued appointment letters by way of memorandum to 45 candidates.
The Election commission of India then announced general elections to the Goa Assembly on 24 December 2011 and the model code of conduct came into force.
After 2012 Assembly elections, the BJP government that came to power nullified these appointment, so the selected candidates approached the court. Two petitions were filed which were then clubbed by the HC and heard together.
