PANJIM: The High Court of Bombay at Goa has stated that the construction of buildings at Calapor village of Tiswadi Taluka will be subject to the outcome of the Court order.

The Court made this statement while hearing a public interest litigation (PIL) writ petition filed by activist Swapnesh Sherlekar and Samil Volvaikar, who had prayed to stay all development and construction activity at Calapor, near Bambolim till final disposal of the petition.
The petitioners had stated that there was a blatant violation of the Regional Plan 2021 and the Goa Building Rules and Regulation 2010. He stated that the technical clearance granted by the Town and Country Planning (TCP) Department for proposed construction of commercial buildings and revised existing access road was resulting in traffic congestion on the adjacent national highway.
The additional third floor granted to the existing block building was in violation as the setback which was 21 metres and had not maintained 30 metres setback as per the Goa Land Development and Building Regulations 2010.The commercial building has been approved in the settlement zone which is also violation of the Goa Land Development and Building Regulations, 2010.
The petitioners alleged indiscriminate hill cutting and brought to the notice of the Court that the Goa State Expert Appraisal Committee (GSEAC) in March 2023, had clearly recorded that the deponent was illegally undertaking mining of a hill under the garb of requiring the soil for making service road in survey No. 110/1 and 111/1 in Calapor Village. It was further recorded that the back vision of the site clearly indicates a pristine area with hills, trees, plantations and vegetation which were destroyed from the site which clearly violates environmental laws.
