PANJIM: The High Court of Bombay at Goa has asked the Tiswadi Mamlatdar to conduct surprise inspection of the two premises which were sealed at Mala, Panjim at specified intervals following a complaint that some occupants continue to reside in the premises by defying the Court order.

In May this year while hearing a writ petition filed by former CCP councillor Menino Da Cruz, Vinayak Mahale and Amey Naik, the Court had ordered the Tiswadi Mamlatdar to seal two of the illegal structures including ground plus two floors and RCC structure and to file a compliance report.
According to the petitioners, the structures were illegal and unauthorised and had no occupancy certificate. The Court had also reprimanded the North Goa Planning and Development Authority (NGPDA) for allowing illegal constructions to come up on NGPDA land, right in front of its office at Mala, Panjim, ‘in full view of the NGPDA officials’.
During the hearing, the counsel for the respondents Alex Fernandes submitted that an appeal has been filed against the demolition order before the Secretary (Urban Development). But there was no stay order as of now on record, the court observed.
Adv Rohit Bras De Sa, counsel for the petitioners complained that thought the two premises were sealed, some occupants were defying the order and continue to reside in the premises during night hours.
The Court has proposed to disconnect the electricity and water connections after a detailed report is submitted by the Mamldatar about the sealing of premises. The Mamlatdar has to ensure either by himself or through his representative that there is surprise inspection of the premises at specified intervals.
