The defense theory that deceased Nadia Torrado had consumed Ratol mistaking it as toothpaste has failed to convince Additional Sessions Judge, B P Deshpande.
“Ratol is a poison having bitter taste and one could immediately make out as to whether it is toothpaste or something else whenever put in the mouth even by mistake for brushing purpose. On realising this, a person will certainly try to spit out the entire contents if it is taken by mistake and the contents will not go inside the stomach, which is not the case in this matter”, Judge Deshpande observed.
Moreover, the Judge said the first statement or the history given by the mother of the deceased at Apollo Victor hospital clearly shows that the poison was consumed at around 9 am in the morning by the deceased and before she was admitted to the hospital, there was history of vomiting on six occasions. “One does not understand as to how by mistake a toothpaste contents could be swallowed without noticing such other substance while brushing teeth.
Judge Desphande said the patient was admitted with the history of consumption of 20×0.5 mg Alphrazolan and unknown quantity of zinc phospide rodenticide.
