MARGAO: The appeal filed by Alzira Ferrao of Chinchinim before the Additional Sessions Judge Vijaya Pol challenging the order of Judicial Magistrate First Class (JMFC), Margao, in the child abandoning case was dismissed and Ferrao was sent to Aguada jail to serve the sentence.
The JMFC had convicted Ferrao under section 217 of IPC for abandoning her new born child near a dispensary in Chinchinim on January 31, 1999. The trial court heard the case and had sentenced Ferrao to undergo imprisonment of two years and pay a fine of Rs 10,000 and in default to undergo imprisonment of six months.
During arguments, Public Prosecutor Subash Dessai submitted before the Additional Sessions Judge that the prosecution case was supported by convincing evidence of eight witnesses, including Dr Silvao Dias Sapeco, Dr R Teles, late Dr Ajay Kudchodkar and Dr Ira Almeida. He further stated that one of the doctors had given evidence that the alleged accused had delivered the new-born baby girl in his nursing home on January 19, 1999 and that she left the dispensary against medical advice. The PP said that there was no infirmity in the trial court judgment and prayed for dismissal of the appeal.
It was argued on behalf of the accused that there were no eye witness and that prosecution had failed to prove motive for abandoning the baby girl.
