NEW DELHI: The Supreme Court on Monday stayed order of the Goa Bench of the Bombay High Court to the Goa Cooperative Marketing and Supply Federation, Panaji, to vacate the premises it has been using as a godown since 1974.
Issuing a notice to Mario Lobo and Fernando Lobo, who own the premises, the Bench of Justices Rohinton Fali Nariman and Ms Indu Malhotra fixed the next hearing on October 12.
The High Court had upheld on July 26 the order passed by the Appellate Board of North Goa on September 1, 2014 to the federation to hand over the premises to the owners.
The federation had claimed that it maintained the premises as a godown used for storing the sacks of wheat, sugar and other goods including oil tins for supply of the controlled commodities to the public and the owners should provide it alternate godown in the market area if they want back the premises.
It had taken the stand in the High Court as also before other authorities that the premises are an old building of more than 120 years and it never changed the use while taking extra precautions in storing the goods and it was not responsible for cracks in the wall that were even before it took possession in 1974.
