PANJIIM: The Sessions Court, North Goa has quashed and set aside the order of the Sub Divisional Magistrate in connection with a petition filed by two crusaders of Save Mollem challenging the action of the police and SDM.
Captain Viriato Fernandes and Dr Bolmax Pereira, who were arrested under preventive measures on December 19, 2020 had challenged the action of the police and SDM, Panjim. Their 19-page Criminal Appeal also questioned the order of the Magistrate claiming that the entire proceedings before the Magistrate were fraudulent and in total violation of the Constitutional and Statutory Mandate of Law.

The plea filed by the released protestors was heard by the Court that had reserved the order for January 8, 2021. Capt Fernandes told Herald that the court has quashed and set aside the SDM’s action in the matter.
Anticipating law and order in the capital, the Panjim Police had arrested the priest and the captain under Section 151 CrPC on December 19, 2020. They were released by the SDM on strict conditions little before midnight.
The appeal further challenged on various grounds the order of the Magistrate directing Captain Fernandes and Dr Pereira to sign bonds and to report at jurisdictional police station.
