VASCO: Goencho Ekvott delegation on Wednesday submitted a memorandum to the Mormugao Deputy Collector demanding that the entire proceedings to acquire land for proposed special railway project of “Londa Vasco Road Over Bridge in lieu of Level Crossing Nos 25 Project” at Cansaulim be scrapped claiming it as “illegal and arbitrary” in nature.
“The Deputy Collector of Mormugao instead of protecting the law is all set to acquire our ancestral land only to satisfy the South Western Railway’s “illegal” plans only to transport coal via our village to private steel plant in Bellary,” Goencho Ekvott alleged.
In a press statement, the GE pointed out to the serious “fraud” done by the Railways as the Ministry of Railways (South Western Railway Construction Organisation), Govt of India, vide its notification SO 1844(E) dated 09/06/2020 issued under sub-section (I) of Section 20A of Chapter IV A of Railway Act, 1989(24 of 1989) published on Nov 17, 2020 in a newspaper is totally “illegal and arbitrary” in nature.
The land acquisition for Over Bridge in lieu of Level Crossing Nos 25 Project in Cansaulim should have been under the “The Goa Compensation to the Project and Vesting of Land in the Government Bill, 2017” clearly states that where any land is acquired by the Government under the Land Acquisition Act, 1894 (Act 1 of 1894), the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013) or any other law, then any dealing with acquisition of land, for the acquired land which has been already marked out and measured and a plan has been made of the same, such land as marked in such plan shall be deemed for compensation under the “ The Goa Compensation to the Project and Vesting of Land in the Government Bill,2017”which came into force on December 1, 2012, it said.
In view of the above, GE demands that the Deputy Collector immediately cancel the acquisition process underway for the above project and take necessary actions against the violators, failing which it would be forced to seek necessary legal action against the concerned persons/organization/department for violation of the rules and regulations of the Government of India.
