PANJIM: The High Court of Bombay at Goa on Wednesday granted conditional bail to Latika Sandesh Khadapkar, who was arrested along with her husband, on the charge of murdering Sarvesh Khadapkar.
High Court single bench Judge M S Jawalkar ordered that Latika be released on a bail of Rs 50,000 with one or two solvent sureties in the like amount to the satisfaction of the learned trial Judge. She has been asked not to leave Goa without prior permission of the court and to attend the hearing of the case on the dates fixed by the trial court.
The applicant has also been asked not to influence, induce, threaten or coerce any witness or abuse the process in any other manner or commit similar or other offences and failing to abide by these conditions, will lead to cancellation of bail.
Latika had filed criminal miscellaneous application seeking her release on bail under Section 439 of the Criminal Procedure Code (CrPC) as her minor daughter, was suffering from Danby Walkar Malinformation (neurological deficiency) since her birth and constantly falls sick. Hence, the child needs continuous monitoring by the parents.
Latika and her husband Sandesh, both residents of Guddem-Siolim, were arrested by the Pernem police on July 10, 2019 under Sec 302, 201 read with 34 of IPC.
Earlier, the Additional Sessions Judge, Mapusa had dismissed their bail applications.
Arguing on behalf of the applicant, Adv Nihal P Kamat told the court that the applicant’s minor daughter was suffering from neurological deficiency since her birth and constantly falls sick. Hence, the child needs continuous monitoring by the parents. So also, due to deteriorating health conditions of the daughter, the applicant being mother, may be granted bail, to take care of the child.
Additional public prosecutor Pravin Faldessai though had opposed the bail application. He conceded to the release of the applicant on the ground of her daughter’s sickness.
