VASCO: The father of the minor who was raped at a Vasco School toilet on January 14, 2013, filed his reply before Judicial Magistrate First Class (JMFC) Vasco on Tuesday. The case has been adjourned till July 4.
In his two-page reply, the victim’s father raised strong objection to the CBI plea for closing the case and requested the magistrate to issue directions to the investigation agency to exhaust all options /possibilities of investigation before closing the case.
Speaking to reporters after filing his reply, victim’s father alleged that the closure report filed by the CBI is bristling with inaccuracies and omissions, apart from indicating that no thorough investigation has been done in the case even by the CBI/ACB Goa.
“In my reply before JMFC Vasco, I have objected to the plea filed by the CBI which had sought permission for closing down the case. I have pointed out several inaccuracies and omissions done by the CBI while investigating. After going through the case papers given to me by CBI, I found that the closure report by CBI is silent on the investigation carried out by the CBI and does not reveal any investigation into the conduct of school headmistress and personnel during the period until the complaint came to be lodged and registered by him. Also it is clear from the evidence on the record that sexual assault on my daughter had taken place, however, the CBI report has no evidence of any identification parade being carried out, including the two suspects named by me,” he said.
“There are several omissions in the CBI report such as the verbal narration of the headmistress to the police. The role of conductor of bus number 4 who used to give chocolates to the victim was not investigated by CBI. No statements were taken of the security guard who was posted at the school gate on January 10 and 11. Likewise, I have mentioned several other omissions in the CBI investigations and I firmly believe that the court would give justice to my daughter by not allowing the CBI to close the case,” he added.
On January 14, 2013, the minor girl was raped in the toilet of the MPT owned Deep Vihar school premises at Headland Sada where she was studying. After local police conducted initial probe, the case was handed over to Crime Branch and then to CBI. However, after investigating the case for over four years, the CBI could not trace the accused and as the case was heading nowhere the CBI officials approached the judicial magistrate first class (JFMC), Vasco, seeking permission to close the case. Disappointed with CBI plea, the father of victim girl then sought time to file his objections and the same was finally submitted before the court on Tuesday.
