A Home Ministry’s order issued in the Extraordinary Gazette on November 22 says the district collectors will hold inquiry in case of each individual and make appropriate recommendations to the Centre through the state government, following Schedule III of the Citizenship Rules, 2009.
The order that remains in force for two years stipulates that applications and objections shall be invited after due publicity by the district collector.
It says the inquiry shall be conducted in fair and transparent manner and the recommendations shall be made to the Centre giving details of each case.
“The fact that a citizen of India has obtained on any date a passport from the Government of any other country shall be conclusive proof of his having voluntarily acquired the citizenship of that country before that date,” says Schedule III.
It says the government can ask a person to prove with a period fixed by it to prove that he has not voluntarily acquired the citizenship of that country.
It adds that the burden of proving so shall rest on the person concerned.
