PANJIM: A writ petition filed by late Fr Bismarque Dias seek to demolish an illegal construction within the Non Development Zone (NDZ) has been held up following a civil review application filed by one Rajani Fadte seeking to review the order of the High Court of Bombay at Goa directing to demolish the structure within three months.
The Division Bench by an order dated May 2, 2023 had ordered demolition of the illegal structure built by Rohidas Narvekar of Akhada, St Estevam. The Court had also confirmed the earlier order dated September 16, 2016 by which the subject premises were already sealed and further directed that necessary demolition should be completed within three months and compliance report be filed.
During the hearing of the review application before the Vacation Court Judge Bharati Dangre, Additional Government Advocate N Vernekar told the Court that on May 29, the Tiswadi Taluka Deputy Collector went to the site to carry out the demolition as per the Court order but the team was obstructed from undertaking the demolition.
However, Adv N A Takkekar, arguing on behalf of the review petitioner disputed the same. But the Court observed that the said structure could not be demolished from the date of passing of the order.
During the hearing, Adv Rohit Bras de Sa produced photographs showing how the access to the illegal structure has been blocked by putting up a canoe on the road.
