PANJIM: The High Court of Bombay at Goa on Friday reserved its order on the petition of the Maharashtrawadi Gomantak Party (MGP) seeking disqualification of former Congress MLAs Subhash Shirodkar and Dayanand Sopte. The bench has, however, not pronounced the judgment date.
During its last hearing earlier this week, the High Court had sought evidence to prove that Shirodkar and Sopte did not resign voluntarily, which the party failed to show.
The petitioners, Satyawan Palkar and Vikas Prabhu had moved the court alleging that the resignations of the two MLAs, who subsequently joined BJP and were given plum postings in two Corporations were immoral and that acceptance by the Speaker was unconstitutional.
They urged the bench to quash and set aside the Speaker’s order and also sought directions to the Election Commission of India to recommend to the government and the Law Commission amendments to the anti-defection law whereby MPs, MLAs, MLCs who resign without justifiable reasons should be disqualified from contesting fresh elections.
