PANJIM: The High Court of Bombay in Goa has granted interim relief to 31 hutments that had sought rehabilitation before demolition of their houses which they have claimed they are living in for over 25 years at Baina in Vasco. After ordering status quo on the issue, the High Court adjourned the hearing for Thursday.
The petitioners on Tuesday, contended that they are living in Baina for over 25 years, have voter and Aadhar cards with these addresses, hence, the State should rehabilitate them before demolishing their structures.
In a counter argument, Goa government opposed the petitioners’ plea to rehabilitate them. The government contended that the petitioners have encroached on government land for years.
The Mormugao mamlatdar in May this year had served show cause notices, issued by Goa Coastal Zone Management Authority (GCZMA), to 120 illegal structures located along Baina beach to complete the third and final phase of demolitions. The government has already demolished a portion of the illegal structures a few months ago.
The notice that had been served to the residents has been issued under Section 5 of the Environment (Protection) Act, 1986 read with Rule 4 of the Environmental (Protection) Rules, 1986.
In the notice, GCZMA had asked the affected parties to file their reply and submit copies of construction, reconstruction, repair licence, approvals, if any issued by the concerned authorities, including GCZMA, along with the approved plan. The parties have also been told to provide the documents to show the title of property to the office of GCZMA on or before June 16, 2016, failing which final directions, including order of demolition of structures, disconnection of water, power supply would be issued.
However, following all necessary procedures the government last month decided to demolish the 120 hutments in the area as they violate the environmental laws and acts.
