Vehemently opposing the anticipatory bail application filed by Rashikant Gauns in the headless murder case, the Maina Curtorim police has said that Gauns is required in police custody for custodial interrogation in order to identify his role in the commission of offence, locate his absconding associates, recover the missing head of the deceased and to recover the weapons used in the commission of the crime.
Additional Sessions Judge Vijaya Pol heard arguments of defence lawyer, Adv Alban Viegas. The arguments will continue in the court on Wednesday.
In the reply filed by the police in response to the anticipatory bail application, the Maina Curtorim police said investigations has revealed that deceased Sultan Bellary was taken in a Swift Dezire car from Pedda-Benaulim on the night of January 9-10. The police contended that the Swift car and a Maruti van descended at Pedda-Benaulim with seven occupants on that night and the vehicles headed towards Margao with the deceased.
Investigations further revealed that the deceased was taken away on the pretext that he is a thief and has committed theft at Damodar store, Margao, belonging to one Rajesh Naik.
Incidentally, the police submitted to the court that the owner of the Swift Dezire care Nitin Dicholka disclosed that he used to keep his car at the Temple premises at Davorlim that one key was with the Temple Manager, Padmanaban.
The police said that car was being used for the affairs of the Temple, of which Jayesh Naik is the President, who is the brother of accused Govind Naik and shop owner Rajesh Naik.
The police further submitted in the court that investigations have allegedly further revealed that Jayesh Naik and Ashish Kamat allegedly own a company styled as Agro Earth Movers Ventures.
Alleging that Jayesh is the prime suspect in this crime, the police submitted that there are number of mobile phones in this company which were being allegedly used by the different suspects.
“Investigations further revealed that application Gauns is one of the close associate of the prime suspect and they were in constant contact before and after the commission of offence, as evident from their contacts, call details and SDR. It is revealed through the tower location that on the date of offence, the location of the applicant was in and around the scene of offence. Investigations further revealed that the prime suspect Jayesh Naik and his associates including the present applicant are always in close association with each other”, the police further submitted to the court, while opposing the bail application.
