PORVORIM: Mapusa Judicial Magistrate First Class Reina Fernandes on Thursday directed Porvorim Police to register an FIR against Tourism Minister Dilip Parulekar and two others in connection with a plot of land along the CHOGM road at Porvorim.
Allowing the complaint filed by a Panjim-based lawyer, the JMFC directed the police to register FIR under Sections 119, 120 and Section 420 read with 120 B of Indian Penal Code. The JMFC also directed that the FIR be registered against Serula Comunidade attorney Peter Martins and then Administrator of Comunidade of Bardez Irene Sequeira.
Ruling that the complaint filed by the advocate discloses the ingredients of the offences, JMFC directed Porvorim Police to investigate the case after registering the FIR.
In his petition filed under Section 156 (3) of the Criminal Procedure Code, the advocate had drawn JMFC’s attention that despite a criminal complaint filed on November 8, Porvorim Police failed to register FIR against Parulekar.
The lawyer in his petition had contended that Parulekar, Martins and Sequeira by their acts of omission and commission and by acting in criminal conspiracy had caused immense loss to the Serula Comunidade by defrauding prime land at a throwaway price to the detriment of the Comunidade.
When contacted, Porvorim PI S Vaigankar admitted that the order has been passed by JMFC. “However, we are yet to receive the copy of the order. As soon as the order is received, further action will be taken in the matter,” informed Vaigankar.
When asked to comment on the JMFC order, Parulekar told Herald that the order had been passed by the JMFC on the basis of a Supreme Court judgement that an FIR has to be registered within 24 hours of filing of the complaint. “Let the police investigate the matter,” said Parulekar.
