Two judge aspirants allowed to appear for main examination

Granting relief to two aspirants for the posts of Civil Judge Junior Division and Judicial Magistrate First Class the Bombay High Court at Goa on Thursday directed that the petitioners be allowed to appear for the main examination scheduled on May 2.
While allowing the petition a Division Bench of Justices S J Vazifdar and U D Salvi observed that along with the petitioners all other similarly placed candidates shall also be entitled to appear for the examinations to be held on May 2.
In this regard High Administration has been directed to notify all such candidates about changes in the date and venue of examination.
The High Court administration had declared the petitioners – Archana Pai Bir and Sonia Mandrekar ineligible to appear for the main written examination on the ground that experience certificate produced by them was “not in terms of the advertisement”.
The petitioners submitted that advertisement for the posts required that the candidates should have minimum work experience of three years practice as an advocate. But certificates issued by the Civil Judge Senior Division, Panjim were rejected by High administration and they were declared ineligible.
When the matter came up for hearing on Thursday Registrar of High Court, Kumari I K Jain told the court that certificates produced by the candidates were issued by the in-charge judge and not by the Senior Division Judge himself.
To which the Division Bench pointed out that it is irrelevant which judge issued the certificates as the petitioners are practicing as advocates from 2003.
While allowing the petition the court has now granted liberty to the candidates to apply for fresh experience certificates in terms of the advertisement by the time of the interviews. And if granted the candidates can furnish fresh certificates if they so desire, Court observed while disposing off the petition.
