Congress on Thursday claimed that the Speaker’s “illegal” rejection of the notice itself is cause to move a fresh No Confidence Motion against him. Party spokesman and former Union minister Ramakant Khalap said that as per the law even one MLA has a right to move a no-confidence motion. “In the case of Congress, 16 MLAs had issued the notice against the Speaker,” he said. “The notice has to be decided by the House and not by the Speaker,” he said, adding, “While the notice is to be moved minimum 14 days prior, the Session can be called after a month or even after six months.” Khalap said that once notice is served, it goes to the Business Advisory Committee (BAC), which decides when it will come up before the House for discussion. “Then, the Speaker has to move leave to introduce the notice, which is to be decided by 1/3 of the House,” he said. “Speaker’s decision to reject our notice is illegal. And this itself is a ground for us to move for fresh notice,” he said.
